F is For Tours Liability Waiver

This Liability Waiver & Hold Harmless Agreement (“Agreement”) is between F is For Tours (“Company”) and the undersigned participant (“Participant”) for participation in any food tour, island tour, transportation service, tasting experience, or related activity (“Activities”).

1. Assumption of Risk

Participant understands that Activities involve inherent risks, including walking on uneven or slippery surfaces, entering/exiting vehicles, riding on winding or narrow roads, exposure to weather, heat, sun, rain, and consuming foods that may contain allergens. Participant voluntarily assumes all risks, known or unknown.

2. Release of Liability

To the fullest extent permitted by BVI law, Participant releases and discharges F is For Tours, its owners, employees, contractors, drivers, and affiliates from any liability for injury, illness, allergic reactions, property damage, accidents, transportation incidents, or death arising from participation, whether caused by negligence (excluding gross negligence or willful misconduct) or otherwise.

3. Indemnification

Participant agrees to indemnify and hold harmless the Company from any claims, damages, or expenses (including legal fees) resulting from Participant’s actions, failure to follow instructions, misrepresentation of health or allergies, or damage caused to property or third parties.

4. Food Allergy Acknowledgment

Participant understands foods may contain or come into contact with allergens (including nuts, dairy, gluten, shellfish, soy, eggs). The Company cannot guarantee allergen‑free environments. Participant accepts all risks related to food consumption and is responsible for communicating allergies in advance.

5. Transportation & Environmental Conditions

Participant acknowledges that Activities may involve variable road conditions, steps, rocks, sand, heat, humidity, rain, and crowded public areas. Participant agrees to follow all safety instructions, including seatbelt use.

6. Photo/Video Consent

Participant grants permission for the Company to use photos or videos taken during Activities for marketing purposes unless written notice is provided before the tour.

7. Governing Law

This Agreement is governed by the laws of the Virgin Islands. Any disputes will be resolved exclusively in BVI courts.
